Finding the Right Car Accident Lawyer in Arizona
After a serious crash, the calls start almost before you are out of the hospital. The other driver's insurer wants a recorded statement. A body shop wants a decision. Somewhere in there you are supposed to find a lawyer, except you have never hired one and have no way to tell a good injury attorney from a billboard.
That is the gap this page is built for. Post what happened once, and licensed Arizona injury attorneys come to you with offers, instead of you working down a list of firms hoping someone calls back.
Every attorney bidding through LegalBid holds an active Arizona license, and the ones who bid are the ones who actually want your case. We serve people across Arizona, including Phoenix, Tucson, Mesa, Chandler, Scottsdale, Gilbert, Glendale and Tempe.
This page is for you if you were:
●
Hurt in a car or truck crash
someone else caused
●
In a motorcycle accident
●
Hit as a pedestrian or while
cycling
●
Injured in a rideshare, as a
passenger or another driver
●
Left dealing with the aftermath
of a fatal crash in the family
●
Told you were partly at fault
and assume that ends it (in
Arizona, it usually does not)
Arizona car accident basics
A few Arizona rules shape almost every claim, and one of them works strongly in your favor.
Arizona is a fault state, not no-fault. The driver who caused the crash, through their insurance, pays for the harm. There is no swapping claims with your own insurer first the way no-fault states do.
You can still recover even if part of it was your fault. This is the big one. Under ARS 12-2505, Arizona uses pure comparative fault, one of the most claimant-friendly rules in the country. Your recovery is reduced by your share of the blame, but it is not erased. If your damages are $100,000 and you are found 30% at fault, you recover $70,000. You can recover even if you were 99% at fault,
provided your own conduct was not intentional or wilful. Insurance adjusters know this rule cuts against them, which is exactly why they push to pin more of the blame on you.
The clock is two years, and shorter against the government. Under ARS 12-542 you generally have two years from the crash to file a lawsuit. But if a city, county or state vehicle or road is involved, ARS 12-821.01 requires a formal notice of claim within just 180 days, and missing that can end the claim before it starts.
There is no cap on what you can recover. Article 2, Section 31 of the Arizona Constitution bars the legislature from capping injury or wrongful death damages, so there is no ceiling on pain and suffering in most cases. Where a drunk driver caused the crash, a DUI
conviction can be used as evidence of negligence and can support damages, which Arizona also does not cap.
But there's a catch: you can't get blood from a stone. Winning your case is one thing, actually getting paid is another. If the at-fault person has already been found 100% responsible, you'll almost certainly win a lawsuit against them. The problem is that a "win" only matters if they have money or assets to pay you with. If they have no insurance, no savings, and nothing to their name, you could win in court and still walk away with nothing. That's why an attorney might advise against suing that person directly; you'd spend time and money on a case that, even if you win, leaves you empty-handed.
Deadlines that change the two-year rule
2 years from the crash (ARS 12-542)
180-day notice of claim (ARS 12-821.01),
then a shorter suit window
The 2 years generally does not start until the child turns 18
2 years from the date of death (ARS 12-542(2))
Deadline
Standard injury claim
Claim against a city, county or state
Injured child
Wrongful death
Situation
When in doubt, treat your deadline as sooner than you think. Evidence disappears and the earlier date is always safer.
What your claim might be worth
There is no formula, but the value of a claim comes down to a handful of things: your medical bills, future treatment, lost wages and lost earning capacity, vehicle damage, and pain and suffering. Serious or permanent injuries move the number the most, and because Arizona does not cap most damages, there is no artificial ceiling on the non-economic side.
The catch is that the at-fault driver may not carry enough insurance. Arizona's minimum coverage is only 25/50/15, meaning $25,000 per person and $50,000 per accident for injuries, and $15,000 for property, which barely covers a real injury. If the other driver is underinsured, your own uninsured or underinsured motorist coverage can fill the gap, which is why it is worth knowing what your own policy includes. Because attorneys on LegalBid bid to take your case, you can weigh what experienced Arizona lawyers think it is worth before committing to anyone.

Why it pays to look at more than one lawyer
Injury attorneys are not interchangeable, even though the ads make them look that way. What varies:
●
Experience with your specific kind of crash. A motorcycle case is not a rear-end fender bender.
●
Whether they are prepared to take the case to trial, which is what makes insurers take an offer seriously
●
The contingency percentage and how case costs are handled
●
How quickly they move, while evidence is still fresh
●
Whether they actually return your calls once you have signed
On LegalBid the attorneys come to you and compete for the case, which is the reverse of chasing firms one at a time.

Detalles del caso
Me detuvieron el pasado viernes por la noche después de salir de una fiesta. El oficial afirmó que mi nivel de alcohol en sangre era 0.08. Esta es mi primera ofensa y estoy ansioso por las posibles consecuencias.

How attorney fees work for injury cases in Arizona
Almost all Arizona injury attorneys work on contingency. You pay nothing upfront and nothing at all unless they recover money for you. The fee is a percentage of the recovery, commonly around a third if the case settles before a lawsuit is filed and higher if it goes into litigation, since that means more work and more risk. Arizona requires the agreement to be in writing, and case costs like medical records and expert witnesses are handled separately, so it is worth checking whether those come out before or after the fee. On LegalBid you can compare those terms across attorneys instead of accepting the first offer you receive.
